The United States General Services Administration (GSA) is the government agency that oversees many of the government contracts awarded across the country. The GSA oversees $66 billion of procurement annually, including funds allocated under the Federal Acquisition Service (FAS) and the Public Buildings Service (PBS) programs. With such a large procurement budget, the GSA is often the victim of fraud.
If you have information about GSA fraud, call our Yoffy, Turbeville & Reichle, PLC Group today at (800) 898-5192 for your confidential consultation. The accomplished attorneys at Yoffy, Turbeville & Reichle, PLC can help you pursue your whistleblower case.
Common Examples of GSA Fraud
The GSA assists with procurement work for other government agencies. Consequently, procurement fraud is a significant component of GSA fraud.
Procurement fraud is committed when some type of scheme is implemented to improperly manipulate this bid and award system.
- Driving Up Bid Prices: If competing bidders on a project improperly collaborate to drive up the bid price, this constitutes a violation of the False Claims Act.
- Bribes or Kickbacks: Bribes or kickbacks to obtain a bid constitute illegal fraud. Submitting false information to the government to drive up a bid price or bills is also an illegal act that violates the False Claims Act.
- Failure to Comply with “Best Pricing” or Price Reduction Requirements: GSA contractors must certify that they are giving the government the “best price” that is less than or equal to the price it gives other customers. Failure to give the government the best price can violate the False Claims Act. In addition, if the price is reduced for commercial customers after contract negotiations, the GSA contractor must give the government the new reduced price.
- Non-Compliance with Federal Trade Agreements Act: Under the Federal Trade Agreements Act, the government can only procure goods and services from countries that have a satisfactory trade relationship with the United States. GSA vendors are limited to the same agreement and can only sell goods that are made or substantially transformed in these countries.
